Nagaon: As the dates for the 2026 Legislative Assembly elections draw closer, the State Election Commission and district administrations have stepped up their preparations. Nagaon district is no exception. With the aim of conducting the elections in a peaceful and healthy environment, the Nagaon district administration has already taken special measures to further tighten security arrangements (Nagaon Arms Deposit Order).

Order to Deposit Licensed Firearms

To ensure that no untoward incidents occur during the upcoming elections and that citizens can exercise their voting rights without fear, the administration has imposed strict restrictions on firearms. As per the directions of the Election Commission of India, all individuals in Nagaon district holding valid firearm licenses have been instructed to immediately deposit their weapons and ammunition at the nearest police station or at a government-recognized armoury.

This entire process has been initiated in accordance with the Election Commission’s guidelines. In this regard, as per Instruction No. 464/INST/2009/EPS issued on 1 September 2009, the imposition of such restrictions on arms during elections in the interest of public safety is mandatory for the District Magistrate.

Legal Obligations and Administrative Action

The order has been issued by the District Commissioner and District Magistrate of Nagaon, Debashish Sharma , by exercising the powers conferred under Sections 47(1)(a), (b), and (c) of the Arms Act, 1962. The administration has made it clear that strict action will be taken against those who violate the order:

Penal action: As per Clause 3.11(g) of the instructions, any person failing to deposit their firearm within the stipulated time will face legal action under Section 188 of the Indian Penal Code.
Stringent legal measures: In addition to penal provisions, violators will also be liable for action under the amended Arms Act, 1959, and other relevant laws.

Ensuring Security and Rules for Return of Firearms

The district administration has clarified that this directive is temporary and will remain in force only for the election period. Licensed firearm holders will be allowed to retrieve their deposited weapons and ammunition in accordance with prescribed rules only after one week from the declaration of election results.

The primary objective of this special measure is to prevent electoral violence, maintain law and order, and ensure that every citizen can cast their vote without fear.
